Terms of Service

1. Who We Are

Ask Pearl ("Ask Pearl", "we", "our", "us") is operated by Ask Pearl Inc., a Canadian company. Our service is accessible at askpearl.ca. By creating an account, you agree to these Terms of Service.

2. The Service

Ask Pearl provides a subscription-based software platform that allows caregivers (adult children, family members, or other responsible adults) to create a simple, reassuring companion screen for elderly users. The screen includes:

• A reassurance display with customizable messages
• Pearl — an AI voice companion powered by large language model technology
• Contact buttons for calling or FaceTiming loved ones
• Scam warning information
• Optional games and entertainment

3. Not an Emergency Service

Pearl (the AI companion) may not always respond accurately. AI responses are generated automatically and should not be relied upon for medical, legal, financial, or safety decisions.

4. Accounts and Eligibility

To use Ask Pearl, you must:

• Be at least 18 years of age
• Provide a valid email address
• Agree to these Terms of Service
• Be responsible for any seniors you add to your account

You are responsible for keeping your login credentials secure. You may not share your account with others or create accounts on behalf of persons who have not consented.

5. Free Trial and Subscription

Ask Pearl offers a 7-day free trial with full access to all features. No credit card is required to begin your trial.

After the trial period, continued use requires a paid subscription at $29 CAD per month (or the price displayed at time of purchase). Your subscription:

• Renews automatically each month unless cancelled
• Can be cancelled at any time from your account dashboard
• Will remain active until the end of the current billing period after cancellation
• Is non-refundable except where required by applicable law

Prices are subject to change with 30 days' advance notice.

6. Acceptable Use

You agree not to use Ask Pearl to:

• Upload or display harmful, abusive, or illegal content
• Impersonate any person or organization
• Attempt to access other users' accounts or data
• Use the service in any way that violates applicable law
• Reverse engineer, copy, or reproduce any part of the platform

7. Privacy and Data

We take the privacy of seniors and their families seriously. Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

8. Intellectual Property

All content, design, software, and branding associated with Ask Pearl is the property of Ask Pearl Inc. and is protected by Canadian and international copyright law. You may not copy, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Ask Pearl shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to reliance on AI-generated responses, data loss, or service interruptions.

Our total liability in any circumstances shall not exceed the amount paid by you in the three months prior to the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination, your data will be retained for 30 days and then permanently deleted, subject to legal obligations.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
